TERMS & CONDITIONS
Pearl Roads (Private Travel & Mobility Services Provider)
These Terms and Conditions (“Agreement”) govern the provision of travel, tour, transportation, and vehicle rental services by Pearl Roads (“Company”, “We”, “Us”, or “Our”) to any individual or entity (“Client”, “You”, or “Your”) who makes a booking or uses our services.
By confirming a booking, making payment, or using any of our services, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement.
1. SCOPE OF SERVICES
Pearl Roads provides the following services within Sri Lanka:
- Tailor-Made Private Tours
- Standard Tour Packages
- Airport Transfers & Chauffeur Services
- Vehicle Rentals (Self-Drive or With Driver)
All services are subject to availability and written confirmation by the Company.
2. BOOKING & CONTRACT FORMATION
2.1 A contract between the Client and Pearl Roads is formed only upon:
- Written confirmation issued by the Company, and
- Receipt of the required deposit or full payment.
2.2 Quotations are valid for a limited period and are subject to change prior to confirmation.
2.3 The Client is responsible for ensuring all booking details (names, dates, passport details, etc.) are accurate.
3. PAYMENT TERMS
3.1 A non-refundable deposit (amount specified at time of booking) may be required to secure reservations.
3.2 Full payment must be completed prior to the commencement of services unless otherwise agreed in writing.
3.3 Prices are quoted in USD or LKR unless specified.
3.4 The Company reserves the right to cancel bookings without liability if payment deadlines are not met.
3.5 All transaction fees, bank charges, or currency conversion fees are the responsibility of the Client.
4. CANCELLATION POLICY
4.1 By the Client (Tours)
Unless otherwise specified in writing:
- 14+ days before service date: Refund subject to administrative and third-party charges.
- 7–13 days before service date: 50% cancellation charge.
- Less than 7 days: 100% cancellation charge.
No refunds shall be granted for:
- No-shows
- Late arrivals
- Unused services during the tour
4.2 By the Client (Car Rentals)
- 48+ hours prior: No cancellation fee.
- Less than 48 hours: One full rental day may be charged.
4.3 By the Company
The Company reserves the right to cancel services due to:
- Safety concerns
- Insufficient participation
- Operational issues
- Force majeure events
In such cases, the Client shall receive either:
- A full refund, or
- An alternative arrangement of equal value.
5. AMENDMENTS & MODIFICATIONS
5.1 Requested itinerary modifications after confirmation may incur additional charges.
5.2 The Company reserves the right to alter itineraries when necessary due to:
- Weather conditions
- Road closures
- Government restrictions
- Safety concerns
- Unforeseen circumstances
Alternative arrangements of comparable standard shall be provided whenever reasonably possible.
6. CLIENT OBLIGATIONS
The Client agrees to:
- Comply with Sri Lankan laws and regulations.
- Respect cultural, environmental, and local community standards.
- Follow safety instructions provided by guides and drivers.
- Provide valid travel documents and driving licenses where required.
Failure to comply may result in immediate termination of services without refund.
7. VEHICLE RENTAL TERMS
7.1 Eligibility:
- Minimum age requirement applies (as specified at booking).
- Valid driving license and International Driving Permit required where applicable.
7.2 Security Deposit:
A refundable security deposit may be required prior to vehicle release.
7.3 Usage Restrictions:
Vehicles shall not be used for:
- Illegal activities
- Racing or reckless driving
- Subleasing or commercial use without consent
7.4 Liability:
The Client is responsible for:
- Traffic violations
- Parking fines
- Damage caused due to negligence
Vehicle must be returned in the same condition as delivered, subject to reasonable wear and tear.
8. TRAVEL INSURANCE
The Company strongly recommends that all Clients obtain comprehensive travel insurance covering:
- Medical expenses
- Personal accident
- Trip interruption
- Cancellation
- Loss of personal belongings
Pearl Roads accepts no responsibility for medical or personal losses incurred during service use.
9. LIMITATION OF LIABILITY
9.1 Pearl Roads acts as an intermediary between Clients and third-party service providers (hotels, activity operators, transport providers).
9.2 The Company shall not be liable for:
- Injury, illness, or death
- Loss, theft, or damage to personal property
- Delays or disruptions caused by third parties
- Acts of government authorities
- Natural disasters or force majeure events
9.3 Liability is limited to the total amount paid by the Client for the specific service in question.
10. FORCE MAJEURE
The Company shall not be liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:
- Natural disasters
- Epidemics or pandemics
- Political instability
- Strikes or labor disputes
- Government travel restrictions
In such cases, reasonable efforts shall be made to reschedule services.
11. INDEMNIFICATION
The Client agrees to indemnify and hold harmless Pearl Roads, its employees, drivers, and agents against claims, damages, liabilities, costs, or expenses arising from:
- Client negligence
- Violation of laws
- Breach of this Agreement
12. PRIVACY & DATA PROTECTION
Personal information collected during booking is used solely for:
- Processing reservations
- Legal compliance
- Service coordination
The Company does not sell or distribute Client data to third parties except where required for service execution or legal compliance.
13. GOVERNING LAW & JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Sri Lanka.
Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka.
14. SEVERABILITY
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT
This document constitutes the entire agreement between Pearl Roads and the Client and supersedes all prior communications, representations, or agreements.
